‘- According to the Hanafi school, when a thief loses or destroys the property they have stolen, they are subject to punishment (had) or forced to compensate for the loss. This is because in the Hanafi school, compensation and punishment are not imposed on the thief at the same time.'”¿Se puede penalizar al ladrón en esta situación si destruye parte de la propiedad y otra parte queda intacta?”-¿O simplemente se le pide que repare el daño que ha causado?
“Dear brother/sister,”
“According to the Hanafis, this situation does not prevent the application of the punishment of had. If there is a situation that requires the punishment of had, such punishment will be given and the restitution of lost property will not be demanded, but the remaining property will be returned to the owner.”
“La acción de tomar en secreto la propiedad protegida de otra persona por parte de alguien con capacidad de apelación durante la pubertad, se considera robar en secreto algo protegido e intacto de otra persona, con un valor de diez dirhams en plata o su equivalente en bienes.”
“En el Corán se dice lo siguiente:”
“El Profeta Muhammad (la paz sea con él) dijo lo siguiente:”
“When a theft is committed, the punishment of cutting off the hand is applied. In cases where this punishment is not required, reparation of damage is sought.”
“Existen acuerdos entre los expertos legales islámicos.”
“If the stolen property has been destroyed, then the retribution penalty shall not be imposed on a single person. However, if the owner of the property has requested restitution before resorting to the court, then the hand-cutting penalty shall not be applied to the thief. If the owner has asked the judge to apply the penalty prescribed by God, then the thief is not obligated to return the property as it has been destroyed. This is due to what was mentioned earlier. On the other hand, the Prophet (peace be upon him) has said: “
“If the thief is rich, it is applied together. If he is poor, only the minimum is applied.”
“Si el objeto robado tiene un valor similar, se compensará con su equivalente. Ya que la pena por el crimen es el derecho de Dios, y la compensación es el derecho del ser humano. Al igual que en el caso de la compensación y expiación, uno no impide al otro.”
